How much does mediation cost?

The costs of the mediation proceedings, including the participants’ and mediators’ travel and accommodation expenses, are borne by the parents. Please note that the costs for such a mediation are generally much lower than the costs for court proceedings. In addition, you can work out solutions for all relevant topics at the same time so that further court proceedings will not be necessary.

The exact cost of the mediation depends on the mediators who take on the case. In Germany, mediators on average charge 100-130 Euro per hour plus VAT. This can vary in different countries.

PLEASE NOTE: In cases of Child Abduction under the Hague Agreement, in which the child/children are in Germany and a return case has been filed, the cost of mediation could be covered if one or both parents receive legal aid in Germany. Please contact MiKK to find out more.

How long does a mediation last?

The length of a mediation depends on the number of controversial issues, their degree of escalation and the respective framework conditions. In a case of child abduction, we generally estimate a duration of 10-15 hours over a period of 2-3 days.

Do the legal proceedings have to be suspended during cross-border mediation?

No. During the mediation process in cross-border cases you may and should continue to consult your lawyers. In the course of the mediation process it is important for the clients to ensure the availability of their lawyers by telephone or otherwise, so that both may obtain advice at any time throughout the ongoing mediation process.

Can something I say in mediation be used against me in court?

No. All participants in a mediation are bound by confidentiality. Confidentiality encourages open and honest communication between parents which facilitates understanding and positive outcomes during the mediation process.

Can my child participate in the mediation? 

Family mediation is always focused on the best interests of the child. Depending on their age, the child may be involved directly or be heard indirectly through various methods with the consent of both parents.
